Terms of Service Agreement

This Agreement is between The Homeschool Printing Company, LLC d/b/a The Homeschool Printing Company (“THPC,” “we,” “us,” or “our”) and the person or entity using our website or services (“Customer,” “you,” or “your”). Our website is https://thehomeschoolprintingcompany.com/ (the “Site”). By placing an order, creating an account, or otherwise using the Site or our services, you agree to these Terms of Service (the “Agreement”).

Please do not upload or submit any files you are not legally authorized to reproduce. You must hold all rights necessary for THPC to reproduce, prepare derivative works from, distribute, and display the materials you submit (collectively, “Materials”).

Your use of the Site is also governed by our Privacy Policy.

1. Service

THPC provides custom printing and related services. We will produce printed products from Materials you upload or provide, subject to your acceptance of this Agreement, compliance with posted policies on the Site, and our right (in our sole discretion) to decline Materials we deem objectionable, unlawful, infringing, unsafe, or otherwise inappropriate.

2. Permissions & Rights in Materials

You represent and warrant that you have all necessary rights, permissions, and licenses to (a) upload the Materials; and (b) grant THPC the non-exclusive, worldwide right to reproduce, print, display, distribute, and prepare derivative works from the Materials solely to provide the services you request.

3. Our Right to Refuse

If we have any doubt about your rights in the Materials or the legality/appropriateness of the Materials, we may refuse or cancel an order in our sole discretion. If an order is refused after payment, we will refund any amounts paid for unproduced items (less any costs already incurred, if applicable).

4. Orders, Pricing & Payment

You agree to pay the prices and fees posted on the Site (including taxes, processing fees, shipping, and handling). Prices, promotions, and fees may change at any time prior to order acceptance. Orders are deemed accepted when we send an order confirmation. Payment is due at checkout via the methods offered on the Site.

5. Proofs, Production & Color Variance

  • Proofs. If you select a proof option, you must review and approve the proof; production timelines begin after approval. If you waive proofs or fail to respond within the stated time, you accept responsibility for errors not caused by THPC.
  • Color/Trim Variance. Minor variations in color, density, paper tone, and trimming (within standard commercial tolerances) may occur and are not considered defects.
  • Bleeds/Margins/Resolution. You are responsible for file setup (bleeds, safe margins, image resolution, embedded fonts). We are not responsible for pixelation, font substitutions, or layout shifts resulting from file issues.

6. Shipping, Delivery & Risk of Loss

We ship to the address you provide. Shipping dates are estimates. Title and risk of loss pass to you upon our delivery to the carrier. Carrier delays, weather events, and other circumstances outside our control are not our responsibility (see Force Majeure).

7. Cancellations, Reprints & Limited Remedies

  • Cancellations. Orders may be canceled prior to production. Once production begins, cancellation may not be possible; if allowed, you are responsible for costs incurred.
  • Defects. If your order arrives damaged or materially defective due to our error, contact us within 7 days of delivery with photos and your order number. Our sole obligation is, at our option, to reprint the affected items or refund the price paid for those items.
  • No Returns for Custom Work. Because products are custom, we generally do not accept returns for non-defective items.

8. Customer Conduct & Prohibited Content

You agree not to upload or request printing of Materials that are illegal; infringe third-party rights; contain malware; or promote violence, hate, or unlawful activity. THPC may report suspected unlawful content to authorities.

9. Account Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

10. Additional Site Terms

You agree to comply with all policies, guidelines, FAQs, file specs, and other terms posted on the Site, all of which are incorporated into this Agreement.

11. Warranty Disclaimer

THPC PROVIDES THE SITE AND SERVICES “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow the exclusion of implied warranties; in those places, the foregoing applies to the fullest extent permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THPC’S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO THPC FOR THE ORDER AT ISSUE. IN NO EVENT WILL THPC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations; in those places, the foregoing applies to the fullest extent permitted.

13. Indemnity

You agree to defend, indemnify, and hold harmless THPC, our owners, affiliates, and employees from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your Materials; (b) your use of the Site or services; or (c) your breach of this Agreement.

14. Intellectual Property; Feedback

The Site, THPC trademarks, and our content are owned by THPC or our licensors and are protected by law. If you provide feedback or suggestions, you grant THPC a perpetual, irrevocable, royalty-free right to use them without restriction.

15. Electronic Communications & Signatures

You consent to receive communications electronically and agree that clicking to accept, placing an order, or otherwise indicating consent constitutes your electronic signature with the same force and effect as an original signature.

16. Governing Law

This Agreement is governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17. Venue; Jurisdiction

You agree that any action arising out of or relating to this Agreement or the services will be brought exclusively in the state or federal courts located in Minnesota, and you consent to their personal jurisdiction and venue.

18. Suspension; Termination

We may suspend or terminate your access to the Site or services at any time for violation of this Agreement, unlawful activity, or risk to THPC or others. Sections that by their nature should survive (including 2–5, 7–13, 15–22) survive termination.

19. Changes to the Terms

We may update these Terms from time to time by posting a revised version on the Site with a new “Last Updated” date. Continued use of the Site or services after the effective date constitutes acceptance of the revised Terms.

20. Assignment

You may not assign this Agreement without our prior written consent. We may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of assets.

21. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supplier failures, carrier delays, governmental actions, or utility interruptions.

22. Miscellaneous

  • No Waiver. A failure to enforce any provision is not a waiver of that or any other provision.
  • Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will remain in effect.
  • Entire Agreement. This Agreement, together with policies posted on the Site (including the Privacy Policy), constitutes the entire agreement between you and THPC and supersedes prior or contemporaneous understandings regarding the subject matter.

Notices to The Homeschool Printing Company must be sent to the postal address above; notices to you may be sent to the email address or mailing address you provided during checkout or account creation.

By using the Site or placing an order, you acknowledge that you have read, understood, and agree to this Agreement.
